Where an application falls within this category, the application will be processed to the point of determination and submitted to the General Manager (or in the case of the General Manager, to the Council), complete with all relevant details and a firm recommendation for determination.

B.    The authority to approve or modify excludes the authority to –

  • Vary any Council resolution regarding the application
  • Refuse an applicant’s formal request to vary or delete a condition of consent or to approve an application previously refused unless such request can be resolved to the satisfaction of the applicant and Council.  This includes applications under Division 8 of the Environmental Planning and Assessment Act, 1979 to vary decisions previously made.
